Virginia’s commodity permit at § 46.2-1143 reaches 110,000 lb on six axles for gravel, sand, asphalt and crushed stone — within fifty miles, never on an interstate, and only in counties levying a severance tax. There is no statutory list of which counties those are and whether Montgomery County levies one was not established. We are not closing it by assuming.

Beyond weight the rule is one sentence: we need a title, unless the truck is old enough that it never had one. A lost title has a counter replacement; where none exists there is a bonded route. Neither one stops a sale.

The Virginia particular worth knowing is the base its branding test measures against. Under § 46.2-1600 a late model vehicle is salvage where estimated repair would exceed its actual cash value less its current salvage value. Every other state on file compares against the whole pre-damage figure.

A smaller base makes the test easier to trip rather than harder, which is the opposite of what comparing raw percentages would suggest. Virginia also excludes the cost of repairing the engine, transmission or drive axle from its rebuilt test — on a work truck, very often exactly where the largest repairs are.
